1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "your") and Marotino CY LTD ("Company," "we," "us," or "our"), a company incorporated under the laws of the Republic of Cyprus with registration number HE449064 and having its registered address at 9A Evripidou, Limassol, Cyprus, and with Cyprus Tax Identification Code 60017620T.

By accessing or using the MaroPay website at maropay.marotino.com (the "Website") and any related services (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree, you must not use the Website or Services.

2. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding contract to use our Services. If you are accessing the Services on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

3. Description of Services

MaroPay is a payment processing platform operated by Marotino CY LTD that enables businesses to accept card payments globally. The specific services, features, fees, and terms applicable to your use of the platform will be set forth in a separate merchant agreement upon successful completion of our onboarding process.

4. Account and Onboarding

To use the MaroPay payment processing services, you must complete our application and onboarding process, which includes providing accurate and complete information as part of our Know Your Customer (KYC) and Anti-Money Laundering (AML) verification procedures. You agree to provide truthful, accurate, and up-to-date information and to notify us promptly of any changes.

We reserve the right to decline any application or terminate any account at our sole discretion, in accordance with applicable laws and regulations.

5. Use of the Website

You agree to use the Website only for lawful purposes and in a manner consistent with these Terms. You shall not:

  • Use the Website in any way that violates any applicable law or regulation.
  • Attempt to gain unauthorized access to any part of the Website or connected systems.
  • Engage in any conduct that restricts or inhibits any other person from using the Website.
  • Introduce any viruses, malware, or other harmful material.

THE WEBSITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAROTINO CY LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, RESULTING FROM YOUR ACCESS TO OR USE OF THE WEBSITE OR SERVICES.

We reserve the right to modify these Terms at any time. Your continued use after any changes constitutes acceptance of the revised Terms.
